Dear Members,

The following constitutes an explanatory memorandum regarding the application of our rules. Its purpose, aside from giving you an insight of how we apply the rules, is to give all you a uniform understanding of the rules themselves.


For your convenience, the following terms constitute and regulate your conduct in relation to your fellow Members. They can be found on the bottom of each page under the heading “Terms of Use”:

“The User shall not post violent, nude, discriminatory, unlawful, infringing, hateful, pornographic, or sexually suggestive photos or other content via DosMovies

You shall not defame, stalk, bully, abuse, harass, threaten, impersonate, or intimidate people or entities and you shall not post private or confidential information via DosMovies including, without limitation, yours or any other person's credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.

You shall not create or submit unwanted email, comments, likes or other forms of commercial or harassing communications (spam) to any of DosMovies users.”


The definitions of the offences in question are subject to common sense. Nevertheless, to ensure a uniform interpretation, the following offences shall have these interpretations:

•Discriminatory content, aside from the obvious interpretation, also includes:
o Racism = prejudice, discrimination, or antagonism directed against someone of a different race based on the belief that one's own race is superior; and
o Sexism = prejudice, stereotyping, or discrimination, typically against women, on the basis of sex.

•Hateful content, aside from the obvious interpretation, also includes:
o Hate speech = speech that attacks a person or a group on the basis of protected attributes such as race, religion, ethnic origin, national origin, sex, disability, sexual orientation, or gender identity.

•Defame = damage the good reputation of (someone); slander or libel.

•Stalk = harass or persecute (someone) with unwanted and obsessive attention.

•Bully = seek to harm, intimidate, or coerce (someone perceived as vulnerable).

•Abuse = speak to (someone) in an insulting and offensive way.

•Harass = subject to aggressive pressure or intimidation repeatedly. (Please note that on account of the Blocking Function made available to all members, we do not actively enforce the Harassment infraction)

•Threaten = state one's intention to take hostile action against (someone) in retribution for something done or not done.

•Impersonate = pretend to be (another person) for entertainment or fraud.

•Intimidate = frighten or overawe (someone), especially in order to make them do what one wants.



DISCIPLINARY MEASURES

The disciplinary measures prescribed in the Terms of Service provide for partial or full suspension of account functionalities, as well as your means of redress:


FIXED PENALTIES:

1-Day Suspension for publicly discussing admin actions, republishing flagged content, posting flagged content in personal walls, use of flagged content as avatars or nicknames, use of service avatars or images or variations thereof as member avatars, abuse of the reporting function, any instances of abuse, personal attacks, or other, against the Administration/Moderators, either publicly or in PM.

Permanent Ban for Using site addresses, e-mail, and any other information of a promotional nature as a nickname; Registration of service nicknames (admin, moderator, DrEvil, JudgeDredd, SINISTER, etc) or any variation of; Fake registered nicknames. Multiple accounts.


VARIABLE PENALTIES:

7 hours to 1-Day Suspension for Overly crude comments, inappropriate or inflammatory comments, personal attacks, spam, advertisements, infringing content.

1 to 4-Day Suspension for discrimination, defamation, stalking, bullying, abuse, harassment, threats, impersonation, intimidation, and for the posting of private or confidential information, nude, obscene, pornographic, or sexually suggestive photos or other content.

4 to 7-Day Suspension for racism, sexism, hate speech, violence (including incitement to violence), unlawful and hateful conduct.

APPLICATION OF DISCIPLINARY MEASURES

1.The determination of the length of suspension is determined on the severity of the infraction and heavily influenced by contributing factors such as vulgarity, overall demeanor, and Moderator Discretion. In the case where the prohibited conduct/content fits in several categories of infractions, the category with the heaviest penalty will be the applicable one.

2.The Administration may provide 1 warning per Post. Any conduct in violation of the ToS, published in a Post or Comment after the warning is dispensed and irrespective of the User, will result in an immediate penalty commensurate with the severity of the infraction. Warnings are not to be interpreted as an invitation to publicly debate the content of the warning. Any such action constitutes “Publicly Discussing Admin Actions” and is penalized by our ToS.

3.All decisions on infractions are final.

4.The Administration may deviate from the indicated Penalty Scale at its own discretion for any reason or without reason. This applies especially in the case of the habitual and repeat offenders.

5.Flagged content that is republished at any time after the infraction was issued, will attract a penalty of 1-Day Suspension per content republished.

6.The ToS applies in Private Messaging. If a member is abused or harassed via PM, the private nature of the messaging function will not protect the perpetrator from the consequences of the ToS. The Private Messaging function of the Administration is to be regarded as public and as such any instances of abuse or ToS violation will immediately be penalized.

7.Profile walls. Flagged content published on a private wall will attract the consequences of the ToS. Flagged content used as Avatars will count as an infraction per page/thread/comment visited.

8.Abuse of the reporting function. Factually baseless reports that are deemed to constitute a means to abuse Members or the Administration/Moderators through the reporting function, will be penalized.

9.Politeness and/or genuine indications of remorse will go a long way in reducing or even eliminating the penalty imposed. Having said that, if a Member abuses this measure of leniency and immediately proceeds to violate the ToS upon the sentence being commuted, will result in the immediate reinstatement of the commuted sentence, in addition to the sentence imposed for the new violation.

10.Instances of prohibited conduct not included within the ToS, will be dealt with on a case by case basis and decided on the discretion of the Administration.

11.The Administration reserves the right to revise these Terms at any time, without prior notice.

I have been so patient with you, to the point of absurdity. You are always advocating against my discretion which you interpret as bias, when in fact you are the undoubted beneficiary of this "bias" that you are so much against. a) You mention one more time my handle, even in the context of "what a nice weather we have today", and I will suspend you. In fact, dont even make a reference to me, or even look at me in a funny way;

b) You mention the site again or attempt to involve yourself in the administration of the site, and I will suspend you;

c) You post links to external 3d party sites, and I will suspend you;

d) You post politics or even a political innuendo, and I will suspend you;

In fact, you are going to have to work very hard to remain here. All the above constitute a WARNING as per our rules:

You certainly managed to violate all three categories of what not to do. ... On account of your relatively clean and trouble free past, I am going to waive the sexism and hate speech. Having said that, your abusive response went overboard into the overly crude territory without any justification or provocation. And that cannot be waived. However as this is a first time offense, I will impose the minimum sentence.

Ordinarily, I would have given the normal sentence of 1 day suspension per spam post. However, your previous sentence didn't seem to deter you from repeating the same conduct that landed you in hot water in the first place. I am posting this for reasons of transparency.

The day before yesterday, Dr. Evil made the user FemaleLotRfan83 a moderator. She has held this position before, but was fired for abuse of office. I personally think she is incompetent and completely unsuitable for this job.

What's more, if moderators can't work together, it's detrimental to the site. And I care about this site.

As a moderator, I am not willing to work with this person in a team. Therefore, I have presented the case to Dr Evil and asked him to decide who should moderate in the future. I have also suspended FemaleLotRfan83 until a decision is made, an admittedly harsh but necessary measure to keep her away from moderator powers.
